2. Acceptance of these Terms of Use
The KeepingKidsHealthyTV.com and KeepingKidsHealthyTV.org websites (collectively, and individually, the “SITE” or “SITES”) are provided to you without charge, unless otherwise indicated, by Rich Sabreen Enterprises, LLC (“RSE”, “we” or “us”). By visiting and/or using the SITES you are agreeing to these Terms of Use. If you do not agree to these Terms of Use, do not enter or use the SITES in any manner.
These Terms of Use apply to all elements and content available on or through use of the SITES (“CONTENT”), whether the CONTENT was generated by RSE or by others. Such CONTENT may include, but is not limited to, textual elements, visual elements, video, audio, software, trademarks, service marks, user-provided CONTENT (including online forums, pictures, audio and video), or any other features that may be added to the SITES from time to time.
RSE may update these Terms of Use at its sole discretion, without advance notice. It is your responsibility to check these Terms of Use from time to time. Your continued use of the SITES constitutes your agreement to accept the changes which we may make.
3. Use of Content
All of the content on the SITES is provided for informational purposes only. As noted in Section 1 above, this CONTENT is not intended as a substitute for professional medical advice, diagnosis or treatment. Your use of the SITES is at your own risk.

Any use of the CONTENT in a manner not expressly permitted by these Terms of Use may violate copyright, trademark and other laws and may be a breach of this agreement and will automatically revoke your permission to use the SITES.
You may not use any device to interfere or attempt to interfere with the proper workings of the Sites nor may you use any device to scrape Content from the Sites.
All rights not expressly granted in these Terms of Use are reserved for RSE and its suppliers and licensors.
4. Disclaimer of Warranties
THE SITES AND THE CONTENT ARE PROVIDED ON AN “AS IS” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RSE AND ITS SUPPLIERS, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS.
Without limiting anything in the foregoing, RSE and its suppliers, licensors, officers, directors, employees and agents make no warranties or representations regarding the following:
A. RSE does not warrant that CONTENT will be up-to-date, delivered in a timely manner or error-free. Nor will RSE be liable for any technical failure, aberration or delay in the delivery of the CONTENT. Without limiting the preceding two sentences, RSE makes no warranty as to whether CONTENT has been superseded by any new information, treatment or medical development.
B. RSE does not warrant that following any advice, information, opinions, or instructions included in the CONTENT will produce any particular results or deliver a positive outcome.
C. RSE makes no warranty as to the efficacy, appropriateness, potency, effectiveness, legality nor safety of any drug, medical or chemical compound, device or technique referenced in the CONTENT or any products or services which may be advertised or promoted on its site, whether by RSE or by any third party. The inclusion of such advertising or promotion within the SITES is neither an endorsement nor a recommendation by RSE or its suppliers, licensors, officer, directors, employees or agents for the purchase or use of such products or services.
D. RSE makes no warranties regarding any information, products or services available through third party websites which may be linked to the SITES, including, but not limited to, the appropriateness, truthfulness or validity of such information.
5. Registration
RSE may offer you, its customers, the ability to register with the SITES for the purposes of communicating with you. By registering with the SITES you are indicating your willingness to receive promotional messages from RSE. We will provide you with a means of opting-out of receiving such messages in the event you no longer desire to receive them.
6. Liability Limitation
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RSE ASSUMES NO LIABILITY, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR ANY OTHER KIND FOR LOSS OR DAMAGE IN CONNECTION WITH THESE SITES, INCLUDING WITHOUT LIMITATION, LIABILITY RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE SITES, YOUR USE OF ANY OF THE PRODUCTS OR SERVICES ADVERTISED OR PROMOTED WITHIN THE SITES OR FROM YOUR USE OF PRODUCTS AND SERVICES ON OTHER WEBSITES LINKED TO THE SITES. NOR DOES RSE ASSUME ANY LIABILITY FROM UNAUTHORIZED ACCESS TO OUR SITES. WITHOUT LIMITING ANYTHING IN THE FOREGOING, NEITHER RSE, NOR ITS SUPPLIERS, LICENSORS, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS WILL BE LIABLE FOR ACTIONS TAKEN BY THE USER AS A RESULT OF USING THE CONTENT, INCLUDING BUT NOT LIMITED, TO DEATH, PERSONAL INJURY OR DEGRADATION OF MEDICAL OR MENTAL HEALTH, BEHAVIORAL ISSUES, OR ANY OTHER KIND OF LOSS OR DAMAGE.
7. Indemnification
You agree to indemnify and hold RSE, it suppliers, licensors, officers, directors, employees and agents harmless from any loss or claim (including reasonable attorneys’ fees), resulting from, or alleged to result from, your violation of these Terms of Use.
8. Applicable Law
These Terms of Use shall be governed and construed in accordance with the laws of the State of Connecticut, USA, without giving effect to its conflicts of laws provisions. You consent and submit to the exclusive jurisdiction and venue of the state and federal courts located in Connecticut.
If you access the SITES from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
9. Notice and Take Down Procedures ¾ Copyright Agent
If you believe any materials accessible on or from the SITES infringe your copyright, you may request removal of those materials from the Sites by contacting RSE's copyright agent (identified below) and by providing the following information:
1. Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy, or the location (e.g., URL) of an authorized version of the work.
2. Identification of the material that you believe to be infringing and its location. Please describe the material, and provide us with its URL or any other pertinent information that will allow us to locate the material.
3. Your name, address, telephone number and (if available) e-mail address.
4. A statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information that you have supplied is accurate, and indicating that "under penalty of perjury," you are the copyright owner or are authorized to act on the copyright owner's behalf.
6. A signature or the electronic equivalent from the copyright holder or authorized representative.

10. Miscellaneous Provisions
We have the right to terminate your access to the Sites at any time and for any reason.
The failure of either party to insist upon or enforce strict performance by the other party of any provision of these Terms of Use or to exercise any right under these Terms of Use will not be construed as a waiver or relinquishment of such party's rights.
In the event that any provision of these Terms of Use is deemed illegal, invalid or unenforceable under applicable law by a court with jurisdiction over the parties, such provision will be deemed to be modified in accordance with applicable law to reflect as nearly as possible the original intentions of the parties, and the remainder of these Terms of Use will remain in full force and effect.
RSE may assign its rights and obligations under the Terms of Use and upon such assignment RSE may be relieved of any further obligation hereunder.
These Terms of Use and any modifications that might be posted in the future constitute the entire understanding between the parties as to the subject matter hereof, and supersede all prior agreements and understandings.
